Approaches to legal pluralism vary widely across the spectrum of different disciplines. They comprise normative and descriptive perspectives, focus both on legal pluralist realities as well as public debates, and address legal pluralism in a range of different societies with varying political, institutional and historical conditions. Emphasising an empirical research to contemporary legal pluralist settings in Muslim contexts, the present collected volume contributes to a deepened understanding of legal pluralist issues and realities through comparative examination. This approach reveals some common (...) features, such as the relevance of Islamic law in power struggles and in the construction of (state or national) identities, strategies of coping with coexisting sets of legal norms by the respective agents, or public debates about the risks induced by the recognition of religious institutions in migrant societies. At the same time, the studies contained in this volume reveal that legal pluralist settings often reflect very specific historical and social constellations, which demands caution towards any generalisation. The volume is based on papers presented at a conference in Münster (Germany) in 2016 and comprises contributions by Judith Koschorke, Karen Meeschaut, Yvonne Prief, Ulrike Qubaja, Werner de Saeger, Ido Shahar, Katrin Seidel, Konstantinos Tsitselikis, Vishal Vora and Ihsan Yilmaz. L’unité de la science, telle qu’elle est comprise dans l’image symbolique du monde des primitifs, repose sur le concept de correspondance. Elle suppose que le monde est un organisme dont toutes les parties se correspondent, que tout événement d’une sphère du monde a sa conséquence dans les autres sphères, que le monde est soumis à des lois qui constituent la meilleure des harmonies, d’où dérivent les règles de la conduite morale.

Summary In this paper I inquire by way of a phenomenological description whether the experience of an encounter with one's own mortality could not so transform a person's ethos that the virtues of justice, compassion and neighborly love could ensue. I will concentrate on such an encounter in and through the mood of dread. This paper, in opposition to Heidegger, is only concerned with it's effect regarding our ethical comportment. I claim that the mood of dread not only destroys the (...) mood of indifference, but also sends him on a pathway of self‐transforming moods. As to the “understanding” accompanying moods in the field of ethical comportment I try to show that it has the character of a direct non‐ratiocinative insight.RésuméJe voudrais dans cet article examiner, à l'aide d'une description phénoménologique, si l'expérience que constitue la rencontre avec la perspective de sa propre mort ne peut pas transformer l'éthique d'un homme de telle manière que les vertus de justice, de pitié et de reconnaissance de la dignité humaine puissent s'y développer. Je me limite ici à une telle rencontre avec un sentiment d'horreur. Cet article n'aborde — contrairement à la manière dont Heidegger conçoit l'angoisse — que l'effet sur le comportement éthique. Je suis d'avis que le sentiment d'horreur non seulement détruit celui d'indifférence, mais dispose l'homme à vouloir se changer lui‐me̊me. Quant à la »compréhension« des sentiments accompagnant le comportement éthique, je montre qu'elle a le caractère d'une intuition immédiate et non rationnelle.ZusammenfassungIn diesem Aufsatz möchte ich auf dem Wege einer phänomenologischen Beschreibung untersuchen, ob die Erfahrung einer Begegnung mit der eigenen Sterblichkeit das Ethos eines Menschen nicht so verwandeln kann, dass sich die Tugenden von Gerechtigkeit, Mitleid und mitmenschlicher Anerkennung entwickeln können. Ich beschränke mich dabei auf eine solche Begegnung in der und durch die Gestimmtheit des Entsetzens. Dieser Aufsatz erörtert — im Gegensatz zu Heideggers Auffassung der Angst — nur die Wirkung auf unser ethisches Verhalten. Ich bin der Auffassung, dass die Gestimmtheit des Entsetzens nicht nur die Stimmung der Gleichgültigkeit zerstört, sondern den Menschen auch auf einen Weg der selbstverändernden Gestimmtheiten sendet. Was das »Verstehen« begleitender Stimmungen im Bereich des ethischen Verhaltens betrifft, so versuche ich zu zeigen, dass dies den Charakter eines unmittelbaren, nicht‐rationalen Einsehens hat. Bezüglich Lehre und Praxis der Kirche empfindet man vielfach einen Mangel an Barmherzigkeit, vor allem da, wo ein Handeln gemäss der traditionellen Lehre für die Betroffenen eine erhebliche Belastung bedeutet. Im Brennpunkt stehen dabei besonders wiederverheiratete und homosexuelle Menschen, denen sexuelle Enthaltsamkeit zugemutet wird. Da es für solche Zumutung aber starke Argumente geben müsste, sind die vor allem mit Rekurs auf die Bibel vorgebrachten Gründe zu überprüfen. Falls diese aber der Überprüfung nicht standhalten, geht es nicht um Barmherzigkeit, sondern um (...) Gerechtigkeit für die Betroffenen. In anderem Kontext kann der Ruf nach Barmherzigkeit der Bagatellisierung von Unrecht und Schuld dienen. Im Fall der kalabrischen Mafiosi hat Papst Franziskus diese für exkommuniziert erklärt, gegen Plädoyers für Barmherzigkeit von anderer Seite. Dabei umfasst die Rede von der Barmherzigkeit durchaus unterschiedliche Handlungsweisen, die jeweils einer gesonderten ethischen Beurteilung bedürfen. Auch das neuerdings vielfach bemühte Gesetz der Gradualität versucht, ethischen Rigorismus abzumildern und so auf diese Weise eine Art Barmherzigkeit zu ermöglichen, ohne eine 'Gradualität des Gesetzes' zu proklamieren. Among the most important aesthetic concepts – especially in the 18th century – are those of the beautiful and the sublime. Yet, in the various aesthetic theories these two concepts are employed in conjunction with one another in very different ways. There is one system in which the beautiful is the fundamental aesthetic value and the sublime i. e. the great – including grandeur and dignity – is only one of a number of defining characteristics of the beautiful. There is (...) another system in which the sublime is the highest degree of the beautiful i. e. of the extraordinary precious. The most influential systems are dichotomous classifications of the respective aesthetic qualities. These classifications themselves exhibit differences: The beautiful and the sublime oppose each other as loveliness creating affection on the one hand, and the astonishing-sublime creating a shudder on the other, but which in some cases can be blended with the beautiful. Alternatively, the concepts of the beautiful and the sublime are disjunctive in a way that they exclude each other: The beautiful is limited and gives positive pleasure; the sublime is unlimited, it depresses and uplifts the viewer at the same time and therefore gives a negative pleasure. – The concepts of the beautiful and the sublime are obviously characterized according to the system in which they appear. Fleck’s social theory of science refers to many ethnological examples in order to explain how collective thinking and acting constructs certain systems of belief and knowing. According to Fleck, scientific concepts and practices are comparable with magic terms and ceremonies. This essay aims to identify the ethnological sources that Fleck’s epistemology is using. By confronting them with other relativistic theories that were circulating in Lemberg during the interwar period, the originality of Fleck’s own position can be contextualized and explained as (...) well. In his treatises A Defence of Common Sense, Proof of an External World, and Certainty, G.E. Moore wanted to put an end to the modern doubts about the certainty of reality and the ‘external world’ by pointing to the undeniable plausibilities of ‘empirical propositions,’ such as ‘I know that this is my hand’ or ‘I know that the earth had existed before my body was born.’ Wittgenstein, who was intensely grappling with Moore’s proofs during the last one and a half (...) years before his expected death, still questioned these proofs and countered them with his concept of language games – including a different logic of the ‘connection with reality.’ Philosophically, he thereby left many loose ends in all places and admittedly a ‘gap’ between them, which he was no longer able to close. But he prepared for closing the gap by means of his concept of orientation, which he had initiated in his Philosophical Investigations without defining it in this term. In a new interpretation of On Certainty from the perspective of the Philosophy of Orientation, this paper tries to show how the attention to the phenomenon of orientation and the language game in which it is expressed can close this gap and thus carry on Wittgenstein's late philosophy to a certain point. Le philosophe russe Nicolai Vasiliev est connu en tant que précurseur des logiques essentiellement non-classiques, c'est-à-dire de logiques qui diffèrent de la logique classique par l'abandon de principes qui sont corrects en logique classique. La gamme de telles logiques couvre la logique intuitionniste, la logique plurivalente, la logique paraconsistante et les logiques de la pertinence. Dans la première partie de ce texte, j'analyse brièvement les vues de Vasiliev, à savoir sa « logique imaginaire », qu'il présente comme une nouvelle logique (...) non-aristotélicienne. Dans les sections suivantes je discute l'impact des approches de Vasiliev sur la logique du consentement. Ici, les idées essentiellement non-classiques de Vasiliev seront reliées à des logiques non- essentiellement non-classiques, qui ne constituent pas une révision de la logique classique, mais étendent sa puissance expressive. In the text, the autor employs his own philological-hermeneutical methodology, which is called contextual interpretation, in the purpose to (...) clarify the concepts of the first aphorism from "Why I am a destiny", from Ecce Homo, in its own context, in the context of Ecce Homo and in the context of the entire work from Nietzsche.
